Lawyer to Lawyer

I am a veteran civil litigator and appellate lawyer. I have very extensive experience in litigations and appeals involving state and federal securities laws, antitrust laws, commodities laws, and US constitutional law. I have dealt with many cases that turned importantly upon questions of foreign and international law. I have also handled substantial personal injury cases. As part of my pro bono practice, I represented a Florida death row inmate in post-conviction proceedings to vacate the death penalty. (Yes, it was vacated.) I believe my extensive experience qualifies me to work on briefs relating to appeals in any civil or criminal matter--good writing and clear thinking will always go a long way.

I'm ready to assist in any way that would be helpful: either by researching and drafting a brief from scratch, or drafting a brief based on the legal precedents you provide to me, or revising and polishing your own draft brief. In most cases, I am given what amounts to a "Statement of Facts" and a pile of relevant cases, and I will take it from there. Obviously, the more time I have to spend doing original research, the more I have to charge. My usual fee arrangement is to bill on an hourly basis, with a reasonable up-front retainer. I am willing, however, to consider other fee arrangements.

I was first admitted to practice in New York in 1975. My NYS Attorney Registration Number is 1183235. Over the years, I have been an associate and then a partner in Fried, Frank, Harris, Shriver & Jacobson, a major Wall Street law firm. Later, I formed my own small firm and represented both plaintiffs and defendants in a broad range of civil cases. More recently, I have been a solo practioner; on large cases, I have acted as co-counsel or as "of counsel" with various law firms. Martindale-Hubbell gives me an "AV" rating. In addition to my law degree from The University of Michigan (1974), I have a Ph.D. in Philosophy from The University of Michigan (1971).

No one can guarantee a successful result in any appellate proceeding, but a well-drafted, well-reasoned brief gives a litigant the best possible chance. If you are interested in exploring whether I might be able to help on your appeal, please call me at (973) 376-4119, or send me an email at davideweisbergesq@gmail.com. I would be happy to send you a sample of my work via email.
